For the avoidance of doubt, and subject to this Clause 4, we will provide the Services to you for the duration of this Agreement unless: (i) we are unable to provide the Services to you for any reason and/or (ii) this Agreement terminates.

Payment
EVHACS shall endeavour to accurately reflect the cost to avail of the Services per full kilowatt (“the Charges”) at each Product where the Services are available to you. The Charges shall be clearly displayed on or near the Product. The Charges are set in each instance by the owner of the Product where the Services are being made available to you. The Charges may be rounded to the nearest full kilowatt provided. All Charges are inclusive of the prevailing rate of VAT. When you wish to avail of the Services you will be directed to our website https://pay.evhacs.com and you will be required to enter the Product unique identifier which is clearly displayed on the Product. You will have the option to, either, pay-as-you-go, or, prepay, up to the maximum amount set in each instance for the relevant Product. To use the pay-as-you-go method we will ask you to agree a maximum pre-authorisation payment of EUR 50 (or such other amount as may be displayed at the Product for higher-capacity chargers) of which the difference in charging cost and the pre-authorisation will be returned to you. We aim to refund this amount within 24 hours of availing of the Services but it can take up to 5 working days depending on your payment provider. We reserve the right to suspend or withdraw the Services if authorisation is not provided on request. Your pre-authorised card will then be used to pay for availing of the Services. Where you opt for the pre-pay option but do not use the amount paid in its entirety we will refund to you the difference in charging cost and the pre-paid amount. We aim to refund this amount within 24 hours of availing of the Services but it can take up to 5 working days. In cases where you feel we have made an error in the amount for the cost of the charging you can contact us +353 (0)1 485 1882 or email info@evhacs.com. We aim to resolve any dispute within 14 days of receipt of your complaint.
